Payday Notice Posting Requirements By State

The majority of states have laws or regulations which require employees to be paid on a regular basis, such as once a month or every two weeks. The employer may be required to establish regular pay days and inform their employees of when they will be paid. Some states require this notification to be provided in writing.

The six states listed below require employers to post one or more notices in the workplace informing employees of the employer’s regularly-established paydays. Employers may also be required to provide additional information about the payment of wages, such as the time and/or place that payment will be rendered.

The three states listed below require an employer to provide specific payday information, and allow the employer to fulfill this requirement by posting a notice in the workplace:

California

California law requires every employer to conspicuously post a payday notice at the place of work. If it is not practicable to post the payday notice at the place of work, it must be posted in a location where it can be seen by employees on their way to or from their places of work; or at the office or nearest agency for payment kept by the employer.

What Pay Day Information Must Be Provided? The employer must specify the regular pay days, the time of payment, and the place of payment.

Is a Specific Posting Format Required? The California Department of Industrial Relations has created  a Payday Notice posting, but notes that “employer-developed notices are permitted.”

How Can I Satisfy This Posting Requirement? A Pay Day Notice is included on the California All-On-One Poster. The employer must fill in the mandatory information to be in compliance with this requirement.

Colorado

Colorado law requires every employer to conspicuously post a payday notice at the place of work. If it is not practicable to conspicuously post the payday notice at the place of work, it must be posted in a location where it can be seen by employees on their way to or from their places of work; or at the office or nearest agency for payment kept by the employer.

What Pay Day Information Must Be Provided? The employer must specify the regular pay days, the time of payment, and the place of payment. The law also states that the employer must specify “any changes concerning them that may occur from time to time.”

Is a Specific Posting Format Required? The Colorado Division of Labor has created a Payday Notice posting, but notes that “other Notice of Paydays Posters may be acceptable provided that they contain the elements and information required by the law.”

How Can I Satisfy This Posting Requirement? A Pay Day Notice is included on the Colorado All-On-One Poster. The employer must fill in the mandatory information and update it with any changes to be in compliance with this requirement.

Illinois

Illinois law requires every employer to post one or more payday notices at each regular place of business. It must be posted at a position easily accessible to all employees.

What Pay Day Information Must Be Provided? The employer must specify the regular pay days, the time of payment, and the place of payment.

Is a Specific Posting Format Required? No.

How Can I Satisfy This Posting Requirement? A Pay Day Notice is included on the Illinois All-On-One Poster. The employer must fill in the mandatory information and update it with any changes to be in compliance with this requirement.

Nevada

Nevada law requires every employer to post a payday notice in at least two (2) conspicuous places where such notices can be seen by the employees. The notices must be printed in plain type or written in plain script.

What Pay Day Information Must Be Provided? The employer must specify the regular pay days and the place of payment.

Is a Specific Posting Format Required? No.

How Can I Satisfy This Posting Requirement? A Pay Day Notice is included on the Nevada All-On-One Poster. CPC also provides a stand-alone Pay Day Notice Poster for employers to post payday information in a secondary location as required by law. The employer must fill in the mandatory information and update it with any changes to be in compliance with this requirement.

Tennessee

Tennessee law requires every employer to post a pay day notice in at least two (2) conspicuous places where such notices can be seen by the employees as they go to and from work. The notices must be printed in plain type or written in plain script.

What Pay Day Information Must Be Provided? The employer must specify the regular pay days.

Is a Specific Posting Format Required? The Tennessee Department of Labor requires employers to post the Wage Regulations / Child Labor notice, which contains a fill-in space for mandatory payday information.

How Can I Satisfy This Posting Requirement? The Wage Regulations / Child Labor notice is included on the Tennessee All-On-One Poster, as is a standard Pay Day Notice with additional fill-in spaces. CPC also provides a stand-alone Pay Day Notice Poster for employers to post payday information in a secondary location as required by law. The employer must fill in the mandatory information and update it with any changes to be in compliance with this requirement.

Texas

Texas law requires every employer to post a payday notice in conspicuous places in the workplace. The law does not specify the number of locations in which the notice must be posted.

What Pay Day Information Must Be Provided? The employer must specify the regular pay days.

Is a Specific Posting Format Required? The Texas Department of Labor provides Texas Payday Law Poster, but notes that a notice “equivalent” to the provided poster is also compliant.

How Can I Satisfy This Posting Requirement? The Texas Payday Law notice is included on the Texas All-On-One Poster. The employer must fill in the mandatory information and update it with any changes to be in compliance with this requirement. CPC also provides a stand-alone Pay Day Notice Poster that employers can post payday information in multiple locations.

Employers may fulfill this posting requirement  with an electronic posting, as long as the electronic posting otherwise meets the requirements of the Payment of Wages Act.

Alaska

Alaska law requires every employer to provide notice of certain wage payment information in writing at the time of hire and whenever any of this information changes. The employer may give this notice by posting a statement of the facts, and keeping it posted conspicuously at or near the place of work where the statement can be seen by each employee as the employee comes or goes to the place of work.

What Pay Day Information Must Be Provided? The employer must specify the day and place of payment. (The same notice requirements also apply to an employee’s rate of pay.)

Is a Specific Posting Format Required? No.

How Can I Satisfy This Notice Requirement? A Pay Day Notice is included on the Alaska All-On-One Poster. The employer must fill in the mandatory information and update it with any changes to be in compliance with this requirement. (Notice of the employee’s rate of pay must be provided separately.)

Rhode Island

Rhode Island law requires every employer to provide notice in writing at least three (3) paydays in advance of a scheduled change. This can be accomplished by posting a notice that may be readily seen by all employees.

What Pay Day Information Must Be Provided? The employer must provide information on any change to the scheduled payday. The employer may wish to include the effective date of the scheduled change and the new regular payday.

Is a Specific Posting Format Required? No.

How Can I Satisfy This Notice Requirement? A Pay Day Notice is included on the Rhode Island All-On-One Poster, but employees may find it confusing if payday information on the poster is changed three paydays before the scheduled change takes effect. Employers may wish to write their own notice of the upcoming change, and then update the Pay Day Notice on the All-On-One Poster once the change goes into effect.

West Virginia

West Virginia law requires every employer to notify employees of specified wage payment information in writing at the time of hire, and prior to any changes to specified wage payment information. The employer may give notice of changes by posting a notice in a place accessible to employees.

What Pay Day Information Must Be Provided? The employer must notify employees of any changes to the day, hour, and place of payment.  (The same notice requirements also apply to an employee’s rate of pay.)

Is a Specific Posting Format Required? No.

How Can I Satisfy This Notice Requirement? A Pay Day Notice is included on the West Virginia All-On-One Poster. Employers may update payday information prior to the change going into effect, or write their own notice of the upcoming change. (Notice of the employee’s rate of pay must be provided separately.)
